Terms OF SERVICES
RATES
My rates are based upon several factors including the following:
The size of the project
The depth of the project
The demand for my time on current projects
The scope and aim of the project
The turnaround time expected for the project
Your budget
Any of my equipment used is included in costs of service, this includes unlimited use of drones, professional lighting & audio, stabilizers, high-end cameras, and lenses.
Every video created includes 1x song license, this is crucial to make sure you can post your videos online without any issues with copyright.
There are 60 minutes of total travel time included with every call out, additional travel time is $50 per hour.
Obviously, I’m going to do just about whatever I can to work with your budget and specs.
Note: when contacting me, the more information you share the better for both of us. Please share as many details as possible (and if asking for polishing/proofreading/editing, please include a small sample). Every detail of your project is kept strictly confidential. I use the details you send me to put together the most accurate quote possible.
BOOKING RESERVATIONS/DEPOSITS
The client has 48 hours to submit deposit once a request is sent out; if deposit payment is not paid within the time frame noted the invoice will be canceled.
Shoots also must be booked AT LEAST a week in advance of the shoot day.
The purpose of the deposit is to lock in your date + time. If you cancel last minute, I could have booked someone else during that period. I do not write anything down in my calendar until the deposit has been paid, making your desired time slot up for grabs. Nothing is booked until the deposit has been paid. The remainder of your session + travel fee is due immediately following your shoot before we both depart.
Any and all quotes quoted by D’Onjre Young are valid for two weeks only, after two weeks you will need to be re-quoted.
D’Onjre Young requires a non-refundable deposit of 25% of the booking price to reserve any of my services. Once a deposit is secured, D’Onjre Young will create a reservation on his calendar to hold the client’s date and time. The remaining balance will be due the day of shooting.
Upon paying the deposit you have accepted D’Onjre Young's offer for services and agree to pay the remaining balance on the shoot date. If the balance is not paid a 5% late fee will be applied to your account. If the balance is not paid in full within 7 business days legal actions may be taken and/or your account will be sent to collections.
A $35 late fee will be applied up to 30 minutes of scheduled appointment. After 50 minutes your appointment is CANCELLED.
If work is unsatisfactory D’Onjre Young's guarantee policy is to complete work until the client is satisfied with work laid out in invoice and/or contract, unless the client wishes to cancel in which they will receive a refund.
CANCELLATION AND DATE/TIME CHANGES
In the event you cannot make your shoot slot we can reschedule your shoot without resubmitting a deposit. If you know you may need to reschedule please give me a 48 hours’ notice. However, please note that you only get one chance to reschedule before you are required to submit another deposit.
If the weather is crazy/act of god/sickness, you can put your deposit toward a re-schedule. However, if you need to cancel or don’t show up to the session, the deposit will not be refunded.
OVERAGE AND OVERTIME
If the client runs over the time they booked, the price for each hour is the hourly rate for that particular service. Overtime is subject to availability. Payment for any overtime will be invoiced and must be paid before final product is delivered to client.
FORCE MAJEURE (BEYOND THE VIDEOGRAPHER'S CONTROL)
In the event of D’Onjre Young being unable to attend the filming date due to illness, injury, etc. D’Onjre Young will endeavour to provide or recommend the client with a suitable replacement videographer / editor.
D’Onjre Young shall not be liable in the event of bad weather or unforeseen circumstances, including illness, from preventing him/her from completing the work.
In the event of equipment failure beyond the D’Onjre Young’s control, including theft of equipment or material, the videographer is not liable for refund or compensation, but will try to appease the client using any available recorded material. In the unlikely event of a total video failure, liability shall be limited to a refund of monies paid other than the deposits.
D’Onjre Young reserves the right to cease filming or editing if situations arise that are unfit to continue, eg. grounds of safety, mistreatment, offensive or abusive behaviour, or unacceptable working condition. In these instances, D’Onjre Young is not liable for refund or compensation.
POST-PRODUCTION
Video(s) and/or photo(s) will be returned to client within 7 to 10 business days depending on demand. In times of high demand, you can expect video(s) and/or photo(s) returned in 10 to 17 business days.
Video/photo release forms must be signed and returned to D’Onjre Young before the final video(s) and/or photo(s) are returned to the client.
If editing suggestions are not made within 3 business days of client receiving videos and/or proof images, D’Onjre Young will hold files on a hard drive for 7 business days. After the 7th day, a $90 storage fee will be accessed to clients account and invoiced. After 30 days files will be deleted from D’Onjre Young’s hard drives.
VIDEO/PHOTO RIGHTS
Publicity rights/promotional use of images: parties agree All footage created by D’Onjre Young will remain I.P of D’Onjre Young but you will be given the option to purchase raw footage that D’Onjre Young may use images from client’s shoot for commercial use, including, without limitation, promotional videos for exhibition to other potential clients of D’Onjre Young.
